1. Overview & Agreement to Terms

This website is operated by GaugWise. Throughout the site, the terms "we", "us", and "our" refer to GaugWise. By visiting our site, placing an order, or purchasing industrial pressure instrumentation, components, or OEM services from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms").

These Terms apply to all users of the site, including browsers, engineers, commercial purchasers, and OEM partners. Please read these Terms carefully before accessing or purchasing through our store.

2. Products & Engineering Specifications

  • Technical Information: We endeavor to display the technical parameters, drawings, dimensions, and specifications of our pressure gauges, transmitters, and accessories as accurately as possible. However, actual product appearances may slightly vary due to continuous design improvements.
  • Application Suitability: Pressure measurement instruments operate in diverse environments. It is the buyer's sole responsibility to ensure that selected materials (wetted parts, case, seals) and pressure ranges are fully compatible with their specific media, operating temperatures, and system dynamics.
  • Factory Calibration: Standard products are factory-calibrated within stated tolerance classes. Individual certified calibration reports are available upon written request for an additional service fee.

3. Orders, Quotations & Pricing

  • Pricing: All prices displayed on gaugwise.com are in United States Dollars (USD), exclusive of applicable local import duties, VAT/GST, and customs clearance charges, unless expressly agreed otherwise in writing.
  • Formal Quotations & Purchase Orders: For wholesale, project-based, or OEM orders, pricing and lead times specified in formal written proforma invoices or quotations remain valid for the period stated therein (typically 30 calendar days).
  • Order Acceptance: We reserve the right to accept or decline any order, or limit order quantities, in the event of pricing errors, component shortages, or export compliance restrictions.

4. Made-to-Order & OEM Customization

  • Custom Specifications: Custom dial face branding, non-standard threads, special scale ranges, and tailored mounting brackets are manufactured specifically to buyer-approved specifications.
  • Production Confirmation: Production of made-to-order units begins upon receipt of design sign-off and payment/deposit. Once manufacturing commences, custom orders cannot be cancelled or modified without written consent and compensation for costs incurred.
  • Buyer Intellectual Property: If you provide logos, trademarks, or technical drawings for OEM production, you warrant that you own or are authorized to use such intellectual property.

5. Payment Terms

  • We accept international credit cards, PayPal, and approved online payment gateways through Shopify.
  • For bulk commercial or OEM orders, commercial wire transfer (T/T) terms may be arranged through our sales desk. Orders are released for dispatch upon full receipt of cleared funds unless credit terms have been formally extended.

6. Shipping, International Delivery & Customs

  • Shipping Destinations: We ship to designated international destinations via reliable air courier or freight forwarders.
  • Import Duties & Tariffs: The buyer is the importer of record and is responsible for complying with all laws and regulations of the destination country, including payment of all import tariffs, customs fees, and local taxes.
  • Risk of Loss: Risk of loss and title for items purchased pass to the buyer upon handover to the shipping carrier.

7. Warranty & Returns

Our warranty commitments, factory inspection standards, transit damage protocols, and return conditions are governed by our separate Warranty & Refund Policy, which is incorporated into these Terms by reference.

8. Limitation of Liability

To the maximum extent permitted by applicable law, GaugWise and its officers, directors, and employees shall not be liable for any punitive, incidental, special, or consequential damages—including, but not limited to, process downtime, loss of production, damage to connected piping/equipment, or business interruption—arising from the purchase, installation, or use of our products. In all circumstances, GaugWise's aggregate liability shall be limited strictly to the net amount paid by the buyer for the product in dispute.

9. Force Majeure

Neither party shall be held responsible for delay or failure to fulfill obligations caused by circumstances beyond reasonable control, including acts of God, raw material embargoes, government trade sanctions, severe transportation disruptions, or supply chain blockages.

10. Governing Law

These Terms of Service and any separate agreements whereby we provide you goods or services shall be governed by and construed in accordance with standard international commercial practices and applicable laws.
